Terms of use

These terms govern your use of the indicative feasibility tool at ingest.stamfordcapital.com.au ("the Service") operated by Stamford Capital Pty Ltd ("Stamford Capital", "we"). By uploading a feasibility, submitting a questionnaire, or interacting with the chat, you agree to these terms.

1. The service

The Service ingests a property development feasibility (Excel, PDF, or questionnaire answers) and returns an indicative capital advisory read — rate guidance, leverage benchmarks, and a three-agent panel assessment. It exists to help developers understand the shape of available financing and to introduce Stamford Capital's capital advisory team.

The Service is provided free of charge and on an "as is" basis.

2. Not financial advice

Everything the Service outputs is indicative only. It is not credit approval, not personal financial advice, not a recommendation, and not an offer of finance. The Service does not consider your specific financial situation, objectives, or needs. It does not constitute a credit application or pre-approval. No information shown should be relied on as a guarantee of available terms.

Before acting on anything the Service produces, you should obtain independent financial, legal, and tax advice tailored to your circumstances. Stamford Capital accepts no liability for any loss arising from reliance on the Service's output.

3. Acceptable use

You agree NOT to:

• Upload documents that contain personal information of third parties without their consent
• Upload documents you don't have the right to share (e.g. confidential materials owned by a client or employer without authorisation)
• Attempt to reverse-engineer, scrape, or circumvent the Service's security controls (rate limiting, bot challenge, authentication)
• Use the Service to spam, harass, or send unsolicited communications to other people's contact details
• Upload malware, executable code disguised as documents, or otherwise attempt to compromise our infrastructure
• Use the Service for any unlawful purpose or in violation of Australian, EU, UK, or US law

4. Your content

You retain all rights to the documents and information you upload. By using the Service you grant Stamford Capital a limited, non-exclusive licence to:

• Process your uploaded content to generate your indicative report
• Store the uploaded file + generated report so you can revisit them
• Pass anonymised aggregate data (no project names, no addresses, no contact identifiers) to improve our extraction + analysis models

We do NOT publish your content, share it with other users, or use it to train third-party models. You can revoke this licence at any time by requesting deletion.

5. Our content

The Service's code, design, brand, sample data, and report templates are owned by Stamford Capital. The indicative report generated for you is yours to use, share, and quote — but you may not extract, copy, or resell the underlying rate matrix, lender intelligence, or report-generation logic.

6. Communications

By providing your email or phone number you consent to receive communications from Stamford Capital relating to your feasibility submission, including a follow-up from our capital advisory team. You can opt out at any time:

• Email: click the unsubscribe link in any message
• SMS: reply STOP to any text message
• All data: request deletion

7. Service availability

We aim for high availability but make no uptime guarantees. The Service may be unavailable from time to time for maintenance, upgrades, or due to upstream provider outages. We may add, change, or remove features without notice.

8. Limitation of liability

To the maximum extent permitted by law, Stamford Capital's aggregate liability arising from your use of the Service is limited to AUD 100. We are not liable for:

• Loss of profit, revenue, business opportunity, or anticipated savings
• Decisions you make based on the Service's output
• Loss or corruption of data, except where caused by our gross negligence
• Outages or issues caused by sub-processors listed in our privacy notice

Nothing in these terms excludes liability that cannot lawfully be excluded — including under the Australian Consumer Law.

9. Indemnity

You agree to indemnify Stamford Capital against claims arising from your breach of these terms or your misuse of the Service, including claims that your uploaded content infringes a third party's rights or privacy.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these terms or use the Service in a way we reasonably believe is harmful or unlawful. You can terminate by deleting your data via the deletion page.

11. Changes to these terms

We may update these terms when we change the Service or when law changes. The "Last updated" date reflects the most recent revision. Continued use after changes means you accept the new terms.

12. Governing law

These terms are governed by the law of New South Wales, Australia. You and Stamford Capital submit to the exclusive jurisdiction of the courts of New South Wales for any dispute that cannot be resolved by good-faith discussion.
